The Uniform Evidence Act

The Uniform Evidence Act represents an important Australian law reform. It is the product of the only modern systematic review of the common law rules of evidence in Australia; and its adoption in the Commonwealth, Victoria, New South Wales, Norfolk Island, Tasmania, the ACT and the NT brings welcome consistency to evidence law throughout much of Australia.

However, the adoption of the uniform legislation creates complexity in South Australia, because the common law and the South Australian Evidence Act still apply in the state courts but the uniform evidence law applies in the Federal courts.

This CPD session will outline some of the key features of the Uniform Evidence Act that differ from the South Australian evidence regime. It will focus on the rules relating to hearsay, tendency and co-incidence, and experts.

Presenter: Hon. Catherine Branson, QC (Adjunct Professor)

Catherine Branson QC graduated from the University of Adelaide with a Bachelor of Arts and Bachelor of Laws, and after graduating taught full-time for two years at the Adelaide Law School. She went on to practice as a barrister at the South Australian bar, principally in the areas of administrative law and commercial law. She served as Crown Solicitor of South Australia from 1984-1989, judge of the Federal Court of Australia between 1994 and 2008, and President of the Australian Human Rights Commission between 2008 and 2012. She is now an Adjunct academic staff member with the Adelaide Law School.

Presenter: Ms Kellie Toole, Lecturer Adelaide law School

Kellie Toole graduated from the University of Adelaide with a BA (Hons) and MA, and from Flinders University with LLB/LP (Hons). She has taught criminal law and procedure, and evidence law at the University of Adelaide since 2010. She worked in criminal defence before moving into academia.
